We provide advice on all aspects of Planning and Environmental law to various Private Sector clients. We have wide experience in the project management of major schemes and due to the approach of our multi-disciplinary team can provide advice on both planning consultancy and legal aspects of the planning process.

Project Management and Major Infrastructure Schemes

We have extensive experience of the co-ordination of planning applications for major schemes and being a focal point in a small or large multi-disciplinary team. We already have superb legal and planning consultancy advice available in house and due to our existing contacts within other professions can advise on the make up of an application team to cover all necessary disciplines. We can advise on and take responsibility for:

  • site appraisals;
  • pre-application discussions with the Local Planning Authority;
  • submission of the planning applications together with supporting statements;
  • preparing co-ordinating and advising on Environmental Impact Assessments;
  • public consultation;
  • post submission discussions with the authority to deal with any further outstanding issues;
  • representation at planning committee; and
  • co-ordination of any appeal that may result from the decision of the Local Planning Authority or “Call-in” process.

Planning Policy

We can provide advice on planning policy and how it affects existing and future developments of land-holdings. We can make representations on new and emerging planning policy and follow this through to providing representation at any resulting examination in public.

Highways Advice

We advise on all highways aspects of the development process which include both Highways and Rights of Way. 

Infrastructure Agreements (Planning and Highways)

We have experience of dealing with a varying complexity of Planning agreements (Section 106 Agreements) and Highways agreements (Section 38/278 Agreements) for Private Sector clients, from smaller residential developments to large mixed use developments. We have dealt with all aspects of planning obligations to mitigate the effects of development including Affordable Housing, Highways Works, Open Space, Management Companies and Leisure Services.

Development Control Advice

We can provide advice on all aspects of development control on the effect of existing planning conditions and prospective modification of these, Enforcement issues, Certificates of Lawful and Proposed Use and Development, Listed Buildings, Tree Preservation Orders and Conservation Areas. 

Representation and Expert Witness

We can provide representation or expert witness assistance in respect of:

  • Any Planning Committee, Public Inquiry or Hearing which result from the Development Control process;
  • Any Examination in Public arising from representations made on emerging Planning Policy.

Environment

We can advise on Environmental issues including:

  • Environmental warranties;
  • Environmental Impact Assessment (see Project Management Section);
  • Waste issues;
  • Noise;
  • Contamination and issues relating to the purchase and sale of contaminated land;
  • Other issues arising from the Environmental Protection Act regime.
