First prosecution under the Bribery Act 2010 – Update

October 28th, 2011 by Sarah Wheadon

This is an update to the earlier post on this first prosecution, from 6 September 2011.

Mr Patel, the court administrative clerk who was the first person to be prosecuted under the Bribery Act 2010 has pleaded guilty to an offence under section 2 of the Act, which prohibits requesting, agreeing to receive or accepting a bribe.

In a press release, the CPS said “This prosecution is the first of its kind under the Bribery Act 2010 which has provided a significant weapon in the armoury of prosecutors that enables us to focus on the bribery element rather than general misconduct behaviour. We will continue tot target those who act corruptly purely for personal gain and tailor the charge to reflect their wrong-doing“.

Mr Patel will be sentenced on 11 November.
