Alternative Dispute Resolution 

Alternative dispute resolution embraces a wide range of processes and forums to resolve disputes, avoiding the need for the adversarial arena of a Court Trial.  It includes mediation, arbitration, expert determination and, in the context of construction disputes, adjudication.  ADR enables commercial settlements to be agreed between the parties rather than imposed by the Court at a trial.  Such settlements can frequently provide for terms and solutions to the dispute which the Court may not be able to order.  Another benefit is that important commercial or private relationships can be maintained which would otherwise be threatened by Court Proceedings.

Mediation

Paris Smith has a dedicated Mediation Team of qualified and experienced mediators, with a wide range and depth of expertise in mediating civil, commercial and family disputes.

Additionally, our lawyers regularly represent clients at mediations.  They are able to advise as to the tactics to adopt to maximise the prospects of achieving a successful outcome to a mediation.  Many disputes involving complex issues and of high value have been resolved through the mediation process, thereby avoiding the costs which might be incurred in a fully contested litigation action.
